The President of the Republic of Somaliland, H.E. Muse Bihi Abdi issued a Presidential Decree titled JSL/XM/G/083-859/052022, appointing an independent investigative committee to report on Somaliland’s National Electoral Commission.

We set out the Presidential Decree as follows:-  

Presidential Decree

PURPOSE: APPOINTMENT

Having Seen: Article 90 of the Constitution of the Republic of Somaliland;

Having Seen: Article 13, Paragraphs 1 and 2 and Article 15, Paragraphs 1 and 2 of the General Election and Voter Registration Act; Lr Code: 91/2020;

Having Seen: Letter No. KDQ/XK/008/2022, dated 25/04/2022, for the purpose of a Requesting an investigative committee;

Having Seen: Letter No. GDQ/XK/009/2022 dated 27/04/2022, for the purpose of a change in the leadership of the National Electoral Commission;

Having Seen: Ref HAN/GQ/05/62/2022, dated 05/05/2022, from the Office of the National Treasurer, for the purpose of submitting an investigative report;

Having Seen: Report XGD/WM/02/08/191/2022, dated 05/05/2022, issued by the Office of the Auditor General, for the purpose of reporting on the audit of the National Electoral Commission;

Having Seen: The importance of the National Electoral Commission on the democratic process in the country and the implementation of free and fair elections;

Having Seen: Administrative and financial disagreements between the members of the Commission could be an obstacle to the performance and duties of the National Electoral Commission;

Having Received: The legal advice of the Attorney General;

I Decided;

To appoint the members whose names are listed below to be an independent Commission of Inquiry reporting on the National Electoral Commission, in accordance with Article 15, Paragraphs 1 and 2 of the General Election and Voter Registration Act; Lr Code: 91/2020;

  • Maxamed Jaamac Cabdi Guddoomiye
  • Farxaan Maxamed Cali Xubin
  • Siciid Xasan Habbane Xubin
  • Axmed Saleebaan Jaamac Xubin
  • Bashiir Cabdi Xariir Xubin

 The committee will investigate issues including:

  •  Administrative and financial system of the Commission members.
  •  Sales system and contracts for services and equipment of the Commission.
  •  System of administration and registration of durable assets of the Commission.
